The confiscation of the “Grand Hotel La Sonrisa” in Sant’Antonio Abate, Naples province, has been postponed again. The Campania Regional Administrative Court (TAR) has ruled that the establishment may continue operating until January 29, 2026. This decision came after the Polese family appealed to block the order effectively transferring the property to local authorities.
The definitive confiscation was originally ordered due to illegal land subdivision (“lottizzazione abusiva”). However, three court-appointed experts are now challenging this using urban planning and geological assessments, along with video evidence. They argue to judicial authorities that the construction work neither transformed the territory nor caused environmental or landscape damage.
Meanwhile, two criminal proceedings remain pending concerning the execution order and a request for case review.
Sant’Antonio Abate Mayor Ilaria Abagnale stated: “This judicial measure should not be commented on, but respected. Judges will have more time to properly evaluate the administrative process undertaken by our offices with full transparency and institutional cooperation.”
This follows an April attempt by Concetta Polese to overturn the confiscation before the Rome Court of Appeal.
