A Sassari court has dismissed misconduct charges against two municipal police officers accused of using excessive force during the arrest of a man for assaulting his partner. Judge Gian Paolo Piana today granted the public prosecutor’s request and issued a dismissal decree, accepting that the officers’ actions were justified.
The judge determined the force used—involving batons and physical restraint—was not disproportionate but necessary to overcome the violent resistance of the detained individual, who was actively attempting to evade arrest. The officers, represented by lawyer Giuseppe Scarpa, intervened in Via Araolla in Sassari’s historic center in September 2024 to protect a woman from her assaulting partner.
Upon seeing the officers, the man resisted and fled. Pursued and cornered in Via Torre Tonda, he kicked and punched the officers as they tried to subdue him, forcing them to deploy batons and physically restrain him. The arrested man, assisted by lawyer Giuseppe Onorato, later alleged gratuitous violence, improper baton use, and having his head forced to the ground with a knee. However, local surveillance footage contradicted these claims.
Onorato had formally opposed the dismissal request, but Judge Piana rejected this opposition, confirming the termination of proceedings against the officers.
