The Seventh Civil Court of Naples has suspended the effectiveness and execution of a resolution passed on August 26th, which had seen three members of the San Carlo Theater Foundation’s steering council proceed with the reappointment of Fulvio Macciardi as superintendent. Presiding judge Livia De Gennaro granted the appeal filed by Naples Mayor Gaetano Manfredi, who is also the president of the Foundation, and scheduled a hearing for September 23rd at 11 a.m. for the parties to appear.
This ruling comes a day after a different judge had rejected Mayor Manfredi’s appeal against an earlier August 4th resolution from the steering council. That prior resolution had led to a decree from Culture Minister Gennaro Sangiuliano concerning Macciardi’s appointment.
In granting the appeal, Judge De Gennaro effectively offered some substantive legal criticism of the August 26th resolution. In her view, the deliberation appears “in violation of the rules and general principles concerning the agenda.” She further stated the resolution is “also objectionable due to the indeterminacy/undeterminability of its subject matter” and “constitutes a procedural irregularity concerning the (re)appointment of the superintendent.”
