There is no doubt regarding the legitimacy of Judge Roberto Spanò to conclude the pending trials. Stefano Scati, the President of the Brescia Court, rejected within 48 hours the request for recusal submitted by the magistrate. This request was made following a measure from the Superior Council of the Judiciary (CSM), which had already archived the question of incompatibility related to the presence of the judge’s wife in the local prosecutor’s office. The Brescia edition of Corriere della Sera reports.
According to President Scati, “the CSM plenum affirmed that he must, in fact, conclude the proceedings assigned to him,” thereby confirming the full impartiality of Judge Spanò.
In light of this decision, the trial concerning the execution phase of the Piazza della Loggia massacre will resume on October 20th. Other proceedings before the Court of Assizes presided over by Judge Spanò will also continue. These include the trials for the murders of Sana Cheema, Nerina Fontana, and Santina Delai, as well as the proceeding against Veronese neo-fascist Roberto Zorzi.
