EU-US Tariff Deal Non-Binding, Negotiations Continue as Sovereignty Stressed

The European Commission clarified that the political agreement reached with the United States on July 27, 2025, is not legally binding. While immediate pledged actions will proceed, the EU and US will conduct further negotiations through their respective internal procedures to fully implement the political deal, the Commission stated in its summary of Sunday’s tariff agreement. The Commission emphasized that the pact serves the EU’s core economic interests by fostering stable and predictable transatlantic relations while fully respecting EU regulatory sovereignty and protecting sensitive European agricultural sectors, including beef and poultry.

The announcement follows reports that during the initial meeting at Turnberry, Scotland, former US President Donald Trump requested EU Commission President Ursula von der Leyen impose a 30% tariff on European goods, according to EU Trade Spokesperson Olof Gill. “A few weeks ago we were talking about a generalised 30% tariff,” Gill stated, confirming this was the US starting position. The final agreement sets a general ceiling of 15%. “It’s not the perfect outcome for the EU or the US,” Gill added, “but we are making the best of a difficult situation.”

Discrepancies emerged between the EU’s published factsheet and one released earlier by the White House. Key differences involve tariffs on chips and pharmaceuticals, which the EU maintains are currently untaxed, and the absence of any EU commitment on a digital tax in the EU document. Responding directly to the White House statement implying an EU pledge against Big Tech levies, the EU Trade Spokesperson asserted: “We do not change our rules or our right to regulate autonomously in the digital space. While we confirm no network usage fees and maintaining zero customs duties on electronic transmissions, this does not interfere with our regulatory space.”

The Commission also firmly denied any compromise with the US on EU food, health, or safety standards. “We do not change our rules, our food system, or our health and safety system, which our citizens trust and which took decades to build. It remains fully and firmly in force,” stated Spokesperson Gill. He suggested potential for simplifying implementation within the existing framework through ongoing dialogue with US partners, expecting clarity on this aspect as joint declaration finalization talks proceed.
